I really like the idea of an "independent" judiciary. But like tenure in higher education, a system designed to protect academic freedom or judicial independence from undue influence just ends up in many cases protecting incompetence and bias.
It is a good idea in theory but it’s fragile (like democracy) and perhaps too self regulating. I know judges can be impeached but that’s a difficult thing to pull off.
When I studied control theory and estimation systems years ago, something that struck me was the necessity to make our systems "robust" (can maintain an even keel, not chasing willy-nilly after every new input) without making them "smug" (impervious to change or correction).
Clearly, we don't want our judiciary to bend like a reed to every political wind. One approach to that is to create lifetime appointments. But we also need to have a way to protect the system from a judge who might be inept, or clearly biased, or apparently willing to accept millions of dollars in gifts from highly place benefactors (purely hypothetical example, of course).
It's a fine balance that I feel we used to be better at.
BTW, where on this green earth did Cannon get her law degree?! It is not the job of the prosecutor to lecture her on the laws of this country. Disqualify her now while there's still time!
